1. Identification and Scope of Application<\/h2>

These Terms and Conditions govern access to, use of, and booking of the travel services marketed through www.nilopiensestour.com<\/a>, hereinafter referred to as the \u201cWebsite.\u201d<\/p>

Any person who accesses the Website or books any of the services offered shall be considered a \u201cUser,\u201d \u201cCustomer,\u201d or \u201cPassenger,\u201d as applicable. Making a booking constitutes acceptance of these Terms and Conditions and of the specific conditions applicable to the service booked.<\/p>

2. Purpose of the Website<\/h2>

Ni Lo Pienses Tour SL markets and facilitates the booking of excursions, activities, guided tours, experiences, transfers, boat trips, and other travel services. These services may be physically provided by independent companies or professionals specializing in each destination, hereinafter referred to as the \u201cOperator.\u201d<\/p>

The page for each service will indicate its main characteristics, including, as applicable, duration, itinerary, price, included and excluded services, requirements, restrictions, and cancellation policy.<\/p>

3. Ni Lo Pienses Tour SL and the Operators<\/h2>

Ni Lo Pienses Tour SL acts as an intermediary between the User and the Operator responsible for physically providing the service. Ni Lo Pienses Tour SL manages the booking, provides the Operator with the information necessary to carry it out, and sends the User the corresponding booking confirmation.<\/p>

The actual performance of the activity, as well as the personnel and equipment necessary to carry it out, shall be the responsibility of the Operator. Ni Lo Pienses Tour SL shall not be considered the direct provider of the booked activity, without prejudice to any responsibilities that may legally apply to it in its capacity as an intermediary.<\/p>

4. Information and Specific Conditions of the Services<\/h2>

6. Booking, Availability, and Confirmation<\/h2>

The User must select the service, date, number and type of participants, and any other options required during the booking process. Depending on the service, the booking may be subject to immediate confirmation<\/b> or may be subject to availability confirmation<\/b>.<\/p>

When a booking is subject to confirmation, completing or authorizing payment does not necessarily constitute final confirmation until such confirmation has been communicated to the User. If the requested service cannot be confirmed, an alternative date, time, or service may be offered.<\/p>

If the User does not accept the proposed alternative, the applicable amounts will be refunded.<\/p>

7. Confirmation and Voucher<\/h2>

Once the booking has been confirmed, Ni Lo Pienses Tour SL will electronically send the User the corresponding confirmation and, where applicable, the voucher required to participate in the activity. The User must verify the date, time, number of participants, personal information, meeting or pickup location, and all other booking information<\/b>, and report any error or discrepancy as soon as possible.<\/p>

Errors resulting from incorrect information provided by the User may affect the performance of the service and shall not, by themselves, entitle the User to a refund.<\/p>

8. Prices, Included Services, and Payments<\/h2>

The applicable price will be the price shown during the booking process and may be stated in euros (\u20ac) or another clearly identified currency. The price shall include only those services expressly stated as included on the service page.<\/b><\/p>

Any admission fee, tax, meal, beverage, transfer, service, or other item not expressly listed as included shall be considered excluded. Certain services may require payment at the destination for admission fees, taxes, port charges, environmental fees, park fees, or other charges.<\/p>

Fees and prices established directly by authorities, parks, government agencies, or other external organizations may be changed independently of Ni Lo Pienses Tour SL. 9. Cancellations by the User<\/h2>

The term \u201cFree Rescheduling<\/b>\u201d means that no penalty will be charged for making the change within the stated period, but it does not guarantee availability for the newly requested date. If there is a price difference between dates, seasons, options, or services, that difference must be paid before the change can be confirmed.<\/p>

Changes voluntarily requested by the User after the activity has begun will be subject to feasibility and may result in additional charges payable by the User.<\/p>

11. No-Shows, Late Arrivals, and Voluntary Withdrawal<\/h2>

The User must arrive at the specified location with the advance notice stated in the booking confirmation. Failure to appear, late arrival, or arrival at an incorrect meeting point for reasons attributable to the User may be considered a \u201cno-show<\/b>.\u201d<\/p>

Unless the specific conditions or applicable law provide otherwise, a no-show shall not entitle the User to a refund or rescheduling. Likewise, voluntarily leaving an activity after it has begun shall not, by itself, entitle the User to a refund for any unused services.<\/p>

12. Pickups, Hotels, and Meeting Points<\/h2>

When a service includes pickup, the initially stated pickup time may be approximate. The final pickup time may depend on the hotel or accommodation, pickup area, logistical route, and number of passengers.<\/p>

The User must correctly provide their accommodation details and review the instructions received before participating in the activity. Certain hotels, accommodations, or areas may not offer direct pickup, in which case a nearby meeting point may be assigned.<\/p>

13. Modifications, Weather Conditions, and Force Majeure<\/h2>

Due to weather conditions, sea conditions, safety concerns, road, port, or park closures, decisions by authorities, technical failures, strikes, demonstrations, natural events, holidays, local events, traffic restrictions, or other circumstances beyond the Operator\u2019s reasonable control, a service may be modified, suspended, or canceled in whole or in part. Likewise, when circumstances require, reasonable changes may be made to schedules, itinerary order, routes, stops, vehicles, vessels, places to be visited, or access points.<\/p>

When a service is completely canceled before it takes place due to circumstances not attributable to the User, the User may be offered, as applicable, rescheduling, an alternative, or a refund for the affected service<\/b>.<\/p>

14. Nature and Wildlife Viewing<\/h2>

Activities taking place in natural environments depend on circumstances that cannot be controlled by Ni Lo Pienses Tour SL or the Operator. During wildlife-viewing activities, the presence, number, location, proximity, or behavior of animals cannot be guaranteed<\/b>.<\/p>

The absence of wildlife, or the presence of fewer animals than the User expected, shall not by itself constitute a failure to provide the service when the activity has been carried out in accordance with the planned program.<\/b><\/p>

15. Water, Sports, and Adventure Activities<\/h2>

Certain activities may involve risks and specific requirements arising from their nature. The User must comply with the participation requirements and follow the safety instructions provided by the Operator.<\/p>

Restrictions may apply regarding age, weight, pregnancy, mobility, swimming ability, physical condition, or other safety requirements. The Operator may deny participation when these requirements are not met or when the Operator reasonably determines that participation could compromise the safety of the User or third parties.<\/p>

16. Documentation, Minors, and Border Crossings<\/h2>

The User shall be responsible for having all documentation necessary to participate in the booked service, including, where applicable, a passport, identification document, visas, immigration permits, authorizations for minors, and any other documents required by the authorities. When the service involves crossing an international border, it is the User\u2019s responsibility to verify in advance the requirements applicable to their nationality and personal circumstances.<\/p>

Minors must meet the age requirements established for each activity and travel accompanied or have the corresponding authorizations when required. If the User is unable to participate in or continue the service due to a lack of required documentation or authorizations, there shall be no automatic right to a refund or rescheduling.<\/p>

17. National Parks, Nature Reserves, and Local Regulations<\/h2>

The User must comply with the rules and regulations of national parks, nature reserves, protected areas, archaeological sites, and any other locations visited. When certain admission fees or charges are not included, this will be indicated in the service information where applicable.<\/p>

Amounts established directly by authorities or external organizations may change without the involvement of Ni Lo Pienses Tour SL.<\/p>

18. Personal Belongings and Luggage<\/h2>

Passengers shall be responsible for safeguarding their belongings and personal items during the service. To the extent permitted by law, Ni Lo Pienses Tour SL shall not be responsible for the loss, theft, misplacement, or forgotten personal belongings during the activity.<\/p>

19. Passenger Conduct<\/h2>

The Operator may refuse or discontinue a person\u2019s participation when that person\u2019s conduct could endanger their own safety, the safety of other passengers or staff, property, facilities, wildlife, or the natural environment.<\/p>

Participation may also be denied to individuals who show clear signs of being under the influence of alcohol or other substances that could compromise the safety of the activity.<\/p>

20. Cancellation by the Operator and Additional Travel Expenses<\/h2>

When the Operator permanently cancels an activity and it is not possible to provide the service or offer an alternative accepted by the User, the amounts corresponding to the canceled service will be refunded. Unless otherwise required by law, such refund shall be limited to the amount paid for the affected service<\/b> and shall not include other services independently booked by the User or indirect travel expenses such as flights, accommodations, transportation, meals, or other personal expenses.<\/p>

21. Liability<\/h2>

Ni Lo Pienses Tour SL acts as an intermediary between the User and the Operators responsible for physically providing the services. The Operator shall be responsible for performing the services under its control, including the personnel and equipment used and compliance with applicable operational and safety regulations.<\/p>

Ni Lo Pienses Tour SL shall not be responsible for failures resulting exclusively from incorrect information provided by the User, no-shows, late arrivals, lack of documentation, failure to comply with participation requirements, or other circumstances attributable to the User. Likewise, to the extent permitted by law, Ni Lo Pienses Tour SL shall not be responsible for events or circumstances beyond its reasonable control.<\/p>

Nothing in these Terms and Conditions shall exclude or limit any rights or liabilities that cannot legally be excluded or limited.<\/p>

22. Refunds<\/h2>

When a refund is due, Ni Lo Pienses Tour SL will process it, whenever technically possible, through the same payment method used to make the booking. Refunds will be processed within an estimated period of between 5 and 10 business days.<\/b><\/p>

Once the refund has been processed, the actual posting of the funds to the User\u2019s account may require additional time depending on the financial institution, payment provider, or type of card used. Any differences resulting from the exchange rate applied by the User\u2019s bank when the User\u2019s account is denominated in another currency shall be beyond the control of Ni Lo Pienses Tour SL.<\/p>

23. Right of Withdrawal<\/h2>

Where the legal exception applicable to leisure-related services provided on a specific date or during a specific period applies, the general right of withdrawal applicable to certain distance contracts may not apply. In such cases, the ability to cancel a booking and obtain a refund shall be governed by the cancellation policy disclosed for the booked service, without prejudice to any consumer rights that may apply by law.<\/p>

24. Insurance<\/h2>

Ni Lo Pienses Tour SL recommends that Users obtain travel insurance appropriate to their circumstances and the type of activities booked. In particular, Users are encouraged to obtain coverage for cancellations, medical assistance, accidents, baggage, and other travel-related contingencies.<\/p>

The existence of insurance purchased by the User does not modify the cancellation conditions applicable to the booked service.<\/p>

25. Languages and Translations<\/h2>

The Website may provide content, activity descriptions, and terms in different languages. Certain content provided by Operators may have been translated from its original language.<\/p>

If a material discrepancy is identified between different language versions of the information relating to an activity, Ni Lo Pienses Tour SL may verify the original conditions communicated by the Operator and provide the User with the correct information applicable to the booking. In the event of any discrepancy between the different language versions of these General Terms and Conditions, the Spanish-language version shall prevail<\/b>.<\/p>
